Limited Warranty, Liability and Disclaimers.   Computers for Seniors' online or offline technology support services, our website and all information, documents, products, software, downloads, services, advice, and information (the "Materials"), including all links in the website, are provided "AS IS" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Computers for Seniors assumes no responsibility for errors or omissions with its support services, the content of its website or other information or documents which are referenced or linked. References to their services and products, are provided "AS IS" without warranty of any kind, either expressed or implied. Our website or any electronic publication derived from there could include technical or other inaccuracies or typographical errors. Changes are periodically added to the materials therein. These changes will be incorporated in new versions of our website.

Waiver of Claims.   In no event shall Computers for Seniors be or any third party service provider be liable for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data, profits, or hardware damage, whether or not advised of the possibility of damage, and on any theory of liability arising out of or in connection with the use or performance of this information or services provided by Computers for Seniors, including any information or services in connection with Computers for Seniors' live or online technical support, whether obtained with or without charge.

User's Responsibilities and Conditions.   Prior to seeking technical support, you have sole responsibility for adequate protection and backup of data and/or equipment used in connection with any technical support services or information provided by Computers for Seniors and will not make a claim against Computers for Seniors or its third party service providers for any reason, including, but not limited to, providing inadequate registration information, lost data, re-run time, inaccurate output, work delays or lost profits resulting from the use of the Materials or information provided. You agree to hold Computers for Seniors, Inc. harmless from, and you covenant not to sue Computers for Seniors or its third party service providers for any claims based on using the website or its technical support.   In connection with the services offered by Computers for Seniors, Computers for Seniors will use its best efforts to resolve basic computer technical problems of members. Computers for Seniors will attempt to resolve the member's technical problems in a professional, reasonable and timely manner, taking into consideration the circumstances and nature of the technical problem and current policies. Online response time may be delayed due to research and inquiries. Computers for Seniors' live or online technical support does not assure that every request for technical support will be resolved to the member's satisfaction. Our responses are merely technical advice or suggestions. Technical problems that may arise may be a result of software or hardware errors or problems that may not be correctable or extremely difficult to resolve. Computers for Seniors has limited proprietary information from vendors, manufacturers, and developers, and may not have the ability to find them. If a court of competent jurisdiction finds that liability for damages against Computers for Seniors, its agents, partners and third party providers, regardless of the warranties, disclaimers, and waivers described herein, such damages shall be limited to no more than the total fee Computers for Seniors charged to the member. Such damages shall constitute liquidated damages and are a reasonable estimate of damages to compensate the member regardless of any warning of loss of or corruption of data or damage to hardware.
